At next week's 2006 International Consumer Electronics Show in Las Vegas, Samsung Electronics plans to demonstrate its first cell phone compatible with a fast data download service that many wireless carriers plan to introduce beginning in 2006.

Vodaphone is developing the cell phone, which is still a prototype and will be compatible with High Speed Downlink Packet Access (HSDPA), the company said Wednesday. Services can apply HSDPA to third-generation Wideband Code Division Multiple Access (WCDMA) networks to offer significantly faster data downloads. Vodafone said in September that it planned to begin trials of HSDPA technology in early 2006.
Mega Download Speeds
The Vodaphone service will initially deliver a peak download speed of 1.6 megabits per second, far faster than the maximum of 384 kilobits per second its WCDMA network offers. In time, with future upgrades, the speed will increase to 7 mbps, the carrier said. For users this will translate into a rise in typical data download speed from today's 120 kbps or so to around 425 kbps over HSDPA, according to Vodafone.
The carrier is also considering High Speed Uplink Packet Access (HSUPA), which boosts the upload speed from the cell phone to the network, in 2007 or 2008.
Samsung will demonstrate a working prototype of its cell phone at CES, said company spokesperson Sophia Kim in Seoul.
Cingular Has the Service
Samsung has released few details of the handset as yet, though Kim said the company has completed hardware development and is now working on the phone's software. The phone should be available to Vodafone in the first half of 2006; its availability to users will depend on Vodafone's commercialization plans for HSDPA.
Already one carrier has launched an HSDPA service. Cingular Wireless's Broadband Connect service, which went into service in 52 markets across the United States in December, is based on the technology. Cingular's service provides download speeds of 400 kbps to 700 kbps and is accessible via a laptop modem card for a flat rate of $60 per month.

Samsung to market new phones with Vodafone, Qualcomm

SEOUL (Reuters) - Samsung Electronics Co. Ltd., the world's third-largest maker of handsets, will supply Vodafone Group Plc with new mobile phones that use Qualcomm Inc.'s modem chips, Samsung said on Wednesday.

The new phones will use high-speed downlink packet access (HSDPA) technology that allows subscribers to use multimedia services such as Internet access and video sharing at higher speed and lower costs, Samsung said in a statement.
"Samsung is currently developing the first commercially available HSDPA phone to be launched exclusively for Vodafone," the South Korean firm said.
To manufacture the phones, Samsung will buy Mobile Station Modem from U.S. wireless technology company Qualcomm.
Samsung did not provide financial details of the deal.
HSDPA is a next-step technology developed for use over networks based on WCDMA, the world's most popular third-generation (3G) mobile standard.
It effectively turbocharges WCDMA networks, transferring data several times faster than existing capabilities, providing a critical boost for lucrative but data-intensive services such as music downloads and video streaming.
Samsung is a major mobile phone provider for U.K.-based Vodafone. Samsung is currently discussing selling mobile phones to Vodafone K.K., the Japanese unit of Vodafone Group.
Shares in Samsung ended 0.15 percent lower at 661,000 won on Wednesday, compared with the wider market's 0.39 percent fall.

Treo 700w to launch at CES?
All that has been officially announced about the upcoming Windows Mobile Treo's launch is that it will be soon and exclusively from Verizon Wireless. Technically not even a name has been announced, but it has been called the 700w in rumors since shortly before its debut in September.
A forum poster at HowardForums claims to work for Verizon Wireless and has photos of marketing materials that show a launch date of January 5th which coincide swith Consumer Electronics Show (CES). Verizon Wireless is already expected to launch the next version of V Cast at the show, adding in music downloads to the existing streaming content.

Sprint Swaps Broadband Spectrum With Clearwire
Sprint Nextel and Clearwire have asked for FCC approval to complete a spectrum swap that the two companies worked out in October. The two companies are looking to swap 2.5 GHz licenses for different cities and rural areas around the country. Clearwire will give Sprint licenses to 9 major metro areas in exchange for 61 licenses in smaller markets. This license swap will help Sprint Nextel meet the FCC's demands that the merged company provide wireless broadband to at least 16 major metro areas within four years. It also more closely aligns the licenses to each provider's business plans. Sprint has recently announced several agreements hinting that the company will operate WiMax networks on this spectrum.

Palm Says 3 New Treo Smartphones in 2006
Palm CEO Ed Colligan stated in todays Palm's earnings conference call that Palm will announce three new smartphones next year, in addition to the Treo 700w. Read on for more details.
"We'll roll out the Palm Treo 700w smartphone based on Microsoft's Windows Mobile, and we'll announce three additional new smartphones during calendar year 2006." said said Ed Colligan. During the conference call he further stated that these new models will debut with new industrial designs and at different price points. They will also implement next-generation radio technologies.
Colligan also stated that one of these models was designed specifically for a large international carrier and may not ever see a US release.
This announcement confirms earlier rumors about new Treo products in 2006. That report stated Palm plans a Treo 700p (similar model as the 700w running Palm OS Garnet) as well as two new designs code-named "Hollywood" and "Lowrider".

Bad Ruling on Cell Phone Tracking: What a Difference a G Makes
Yesterday, Magistrate Judge Gorenstein of the federal court for the Southern District of New York issued an opinion permitting the government to use cell site data to track a cell phone's physical location, without the government having to obtain a search warrant based on probable cause.
Judge Gorenstein's flawed legal analysis is in sharp contrast to three other federal court opinions strongly rejecting the government’s legal arguments, including a decision by Magistrate Judge Orenstein in the Eastern District of New York. While Judge Orenstein referred to the government's legal arguments variously as "unsupported," "misleading," and "contrived," and a Texas court called the convolutions of the government’s theory “perverse” and likened its twists and turns to a "three-rail bank shot," Judge Gorenstein bought the government's arguments hook, line and sinker.
Unfortunately, this dangerous new opinion falls into a procedural black hole. Because the DOJ is the only party in these surveillance cases, there's no one left to appeal the decision. Meanwhile, the DOJ has refused to appeal all three times it has lost, despite emphatic requests by the Texas and Eastern District magistrates. The result is that other magistrates across the country won't get clear guidance from the appeals courts on this issue.
That's why EFF will continue to follow this issue closely, and continue to urge other magistrates who face this question to follow the clear and convincing logic of the three courageous judges who stood up for civil liberties and said no to warrantless cell phone tracking.

The DOJ’s practice of monitoring cell phone location without probable cause previously inspired us to ask: "What other new surveillance powers has the government been creating out of whole cloth and how long have they been getting away with it?" Recent revelations about President Bush authorizing warrantless wiretaps of Americans by the National Security Agency have given us the beginnings of an answer. Let's hope that's not just the tip of the surveillance iceberg.

Sprint Nextel to aquire rest of Nextel Partners
In another affiliate buyout deal, Sprint Nextel will buy the remaining shares of Nextel Partners for $6.5 billion. Nextel Partners provides Nextel branded service in rural areas. After the Sprint buyout of Nextel, Nextel Partners contended that its exclusivity contract was violated (since Sprint provides service in some of the same areas as Nextel Partners).
The two companies have haggled for months for a valuation, eventually depending on the average of two appraisers. After the Sprint/Nextel merger, stock of Nextel Partners surged 50% making the deal much more costly.
The deal is expected to close in the first half of 2006.

RIM 3Q Earnings Up on Subscriber Growth

TORONTO - Research in Motion Ltd., the maker of the BlackBerry wireless messaging device, released better than expected third quarter results on Wednesday — quelling some fears that an ongoing patent dispute that threatens to shut down the popular service in the United States is significantly hurting the business.

Net income rose to $120.1 million, or 61 cents per share, from $90.4 million, or 46 cents per share. Revenue rose 53 percent to $560.5 million from $365.9 million and was above analysts' forecasts of $549 million.
Adjusted net income of 71 cents per share topped the 65-cent mean estimate of analysts surveyed by Thomson Financial.
"The business is really soaring. It's not just doing OK. It's soaring," James L. Balsillie, RIM's chairman and CEO told The Associated Press in an interview. "A lot of people have said `Wow, I thought it was all kind of tough,' but we've been telling everybody sales are fine."
RIM said it added 645,000 new subscriber accounts — about 25,000 less than projected after the company released its second quarter results — during the third quarter and at the end of the quarter total BlackBerry subscribers were 4.3 million — more than double than last year.
RIM maintained its forecast for earnings of 76 cents to 81 cents per share for the fourth quarter on revenue of $590 million to $620 million, but lowered its forecast for subscriber additions to a range of 700,000 to 750,000 — about 75,000 less than previously expected.
Dennis Kavelman, RIM's finance chief, said the uncertainty and publicity surrounding the legal patent dispute caused the reduced forecast.
"The impact of this has been to create some uncertainty among customers. The timing of any resolution and the removal of this uncertainty is difficult to predict, therefore taking into these factors we believe it is prudent to lower the range," Kavelman said.
RIM's stock has been battered by litigation that pits it against NTP, a tiny firm that lays claim to the patent technology behind BlackBerry. And though most analysts believe the odds of an injunction shutting down the service is low, some of RIM's larger customers are nervous.
The market was keen to see if there's a reluctance to purchase the device but at least two analysts were impressed with the results.
"The results are definitely better than expected," said Barry Richards, an analyst with Paradigm Capital. "Even the subscriber additions are certainly better than feared. There's no doubt that the third quarter was better. The guidance for fourth quarter is slightly better than expected."
Deepak Chopra, an analyst with National Bank Financial, said the results alleviate at least some of the fears.
"If NTP can get resolved in the near future, and customers get to feel some comfort on the issue, the number of subscribers additions could really start to accelerate here," Chopra said.
RIM shares closed at $61.76, down 32 cents, on the Nasdaq Stock Market before its earnings were released. In after-hours trading, the shares gained $3.64, or 5.9 percent, to $65.40. The stock has traded between $51.90 and $87.95 over the last year as the Canadian company has continued to suffer defeats in the U.S. court system.
In 2002, a federal jury in Richmond, Va., sided with NTP in the patent infringement case, and RIM has since lost in the appeals process.
Now the case is back with U.S. District Judge James R. Spencer, who might issue an injunction as soon as February.
Earlier this year, a tentative $450 million settlement fell apart. Spencer last week ordered RIM and Arlington, Va.-based NTP to submit filings on the injunction by Feb. 1.
But RIM has been victorious in its dealing with the U.S. Patent & Trademark Office. The agency has preliminarily nixed the patents at the heart of the court case. It has yet to issue final rejections, however, and NTP can appeal if the patent office issues its final rejections before Spencer issues a possible injunction.
Most analysts expect the companies to eventually reach a settlement, with some estimating it could be as much as $1 billion.
The company said it was maintaining a previously recorded estimate of $450 million, which was based on an amount in a tentative deal that has been rejected, although it said the actual figure could be higher or lower.

Sprint to carry Motorola again
According to documents posted by the FCC (IHDT56FX1), Sprint Nextel appears to be gearing up for a launch of the Motorola C290. While the C290 is a very basic entry-level handset, the news is notable since Sprint has not caried a Motorola for the PCS network since the V60v in 2004.

The C290 sports no advanced features to speak of, but does include a speakerphone.
If the Sprint-Motorola relationship is indeed on the rebound, Sprint could be in lign to receive handsets like the RAZR V3c and Q.

Nextel Partners Put Price Determined
KIRKLAND, Wash., and RESTON, Va. — 12/20/2005
Nextel Partners (NASDAQ: NXTP) and Sprint Nextel Corp. (NYSE: S) announced today the put price under Partners' charter has been determined to be $28.50 per share of Partners' Class A common stock. This is the price at which Sprint Nextel will purchase Nextel Partners' Class A common stock under the put right in Nextel Partners' charter initiated by Nextel Partners shareholders in October 2005 following the Sprint Nextel merger.
The put price was determined after the two appraisers, Morgan Stanley and Lazard, issued their reports that determined fair market value for Nextel Partners as defined in the charter. As set forth in their respective reports, Morgan Stanley determined fair market value of Partners' equity to be $9.6 billion, or $29.75 per fully diluted share and Lazard determined fair market value of Partners' equity to be $8.8 billion, or $27.25 per fully diluted share.
As provided in the charter, because the two appraisers' values are within 10% of each other, the final fair market value is the average of the two appraisers' determinations. The aggregate amount payable to Partners Class A stockholders will be $6.5 billion including amounts payable upon conversion of debt securities and upon settlement of options. This transaction implies an enterprise value for Nextel Partners at approximately $10 billion.

3.2-Megapixel Camera Phones on the Horizon
MagnaChip Semiconductor, a leading global designer, developer and manufacturer of image sensor solutions, mixed-signal and digital multimedia semiconductors, today, announced the launch of a high-performance 3.2 megapixel CMOS image sensor (MC532MA) for the camera phone application market.
The 2.57u pixel of the MC532MA allows for excellent low-light performance in a small module size, which has typically been a trade off with solutions currently on the market. When implemented in an Auto Focus application, modules of 11x11x7mm or smaller can be achieved. This smaller size will enable OEMs to adopt high-resolution imaging across multiple handset models.
The sensor uses wide acceptance angle pixel technology, which helps to ensure minimum module height while maintaining the crucial corner performance. This new high-resolution CMOS image sensor offers high responsivity, low noise and image quality enhancing filters.
The MC532MA operates at 12 frames per second (fps) at full-resolution and up to 30 fps at SVGA resolution. Special ADC and analog designs allow the sensor to achieve power dissipation below 150mw for full-resolution, full-frame rate operation. The 10-bit Bayer RGB output interfaces to all standard processors, and base-band solutions.

Movie theater owners are aggressively trying to lure movie-goers back into cinemas by petitioning the FCC to allow blocking cell phone service in theaters.
Spearheaded by the National Association of Theater Owners (NATO), John Fithian President of NATO said theater owners "have to block rude behavior" to encourage customers to come back who have stayed home to avoid the aggravation of mobile distractions.
But not everyone is in favor of the move. The Cellular Telecommunications and Internet Association (CTIA), a Washington-based cell phone lobby group, is protesting the action saying it would fight any move to block cell phone signals. "We're opposed to the use of any blocking technology, because it interferes with people's ability to use a wireless device in an emergency situation," CTIA spokesman Joseph Farren said.
Most theaters already have no cell phone policies and show announcements before movies to remind patrons to silence or turn off their devices. Some cinemas even ask customers to check their phones at the door. Still for some owners, this petition is the only way to ensure a ring-free and enjoyable movie-going experience.

Sprint to Give Free Phones and Service to Katrina Victims
Sprint Nextel today announced the details of its participation in the Federal Communications Commission's Katrina Lifeline Program. Through the program, eligible customers in the 92 Gulf Coast counties and parishes affected by Hurricane Katrina will be able to apply for a free wireless phone and service. Existing Sprint Nextel customers affected by the hurricane who qualify for the program will receive a credit of 500 minutes for four months from the date of activation.
"Sprint Nextel is pleased to be participating in the FCC's Lifeline program for Hurricane Katrina victims," said Sal Todaro, area vice president for Sprint. "It is important to Sprint Nextel to help our customers stay connected with their friends and family as they continue rebuilding in the aftermath of Hurricane Katrina."
Since September, Sprint Nextel, its foundation and employees have contributed cash and in-kind donations for hurricane relief worth more than $10 million for the individuals and communities across the Gulf Coast region, as well as for evacuees around the country.
To find out more about Sprint Nextel's Katrina Lifeline program or to apply, eligible customers must call 1-866-705-6925. Customers will be mailed a certification of eligibility form to complete and mail back with a copy of their FEMA letter by March 1, 2006. Consumers eligible for the Sprint Katrina Lifeline program will have the following options:
- New customers will receive a Motorola i415 wireless phone and $60 prepaid service credit from BOOST Mobile, the prepaid wireless brand of the company.
- Existing Sprint Nextel customers will receive 500 free minutes per month for four months from the date of activation of the Katrina Lifeline Program. Existing BOOST Mobile customers will receive additional prepaid calling cards worth $130.
To qualify for the program, consumers must apply by March 1, 2006 and meet the following criteria established by the FCC:
- Participants must be able to certify prior residency in a County or Parish that has been designated by the Federal Emergency Management Agency (FEMA) as eligible for individual disaster assistance related to Hurricane Katrina.
- Participants must be able to document their eligibility by providing a copy of a letter from FEMA demonstrating that they have been approved for disaster housing assistance.
- The program allows for only one wireless phone per household.
- Participants will be required to sign a certification of eligibility form.
Residents of the following counties and parishes have been designated by FEMA as eligible for individual disaster assistance:
Alabama - Baldwin, Greene, Hale, Marengo, Mobile, Pickens, Tuscaloosa and Washington.

Customers will be mailed a certification of eligibility form to complete and mail back with a copy of their FEMA letter by March 1, 2006. The program is subject to certain limitations and conditions including the availability of phones and the company's ability to provide service in all areas.
Consumers eligible for the Sprint Katrina Lifeline program will have the following options:
- New customers will receive a Motorola i415 wireless phone and $60 prepaid service credit from BOOST Mobile, the prepaid wireless brand of the company.
- Existing Sprint Nextel customers will receive 500 free minutes per month for four months from the date of activation of the Katrina Lifeline Program. Existing BOOST Mobile customers will receive additional prepaid calling cards worth $130.
To qualify for the program, consumers must apply by March 1, 2006 and meet the following criteria established by the FCC:
- Participants must be able to certify prior residency in a County or Parish that has been designated by the Federal Emergency Management Agency (FEMA) as eligible for individual disaster assistance related to Hurricane Katrina.
- Participants must be able to document their eligibility by providing a copy of a letter from FEMA demonstrating that they have been approved for disaster housing assistance.
- The program allows for only one wireless phone per household.
- Participants will be required to sign a certification of eligibility form.
Residents of the following counties and parishes have been designated by FEMA as eligible for individual disaster assistance:

Visto Sues Microsoft for Patent Infringement
Mobile e-mail startup Visto has sued Microsoft for allegedly infringing on three of its patents related to how information is handled between servers and handheld devices.
Visto asserts that Microsoft's Windows Mobile 5.0 is a blatant infringement on Visto's patented technology. Its concerns about this market are heightened by Microsoft's recent decision to bundle Windows Mobile 5.0 with their already market-dominating Exchange server software. This method of bundling software has led Microsoft to be prosecuted by competition authorities in the past, and in this case, potentially increases the rate and manner in which their infringement on Visto's patents occurs.
"Microsoft has a long and well-documented history of acquiring the technology of others, branding it as their own, and entering new markets," said Mr. Bogosian, Visto's Chairman, CEO and President. "In some cases, they buy that technology from its creator. In other cases, they wrongfully misappropriate the intellectual property that belongs to others, which has forced them to acknowledge and settle large IP cases with companies like Sun, AT&T and Burst.com. For their foray into mobile email and data access, Microsoft simply decided to misappropriate Visto's well known and documented patented technology."
"With the recent explosion in smart phone technology and demand for mobile email access, the market has caught up with Visto's original vision," said Mr. Mendez. "We worked many long nights over many years and invested heavily to develop and patent our technology at a time when many people thought we were working on future fantasies. Now, when the market potential is obvious to everyone, other companies want to misappropriate the technologies that we invented and to benefit, for free, from our hard work and innovation."

The complaint seeks a permanent injunction that would prohibit Microsoft from continuing to misappropriate Visto's intellectual property. The company also seeks monetary damages as compensation for Microsoft's illegal actions.

New Study Shows Rising Cell Phone Use While Driving
More Americans than ever are using cell phones while driving according to a study by the National Highway Traffic Safety Administration (NHTSA). Driver cell phone use increased in 2005, with 6 percent of drivers on handheld phones in 2005 nationwide compared to 5 percent in 2004.
This result is from the National Occupant Protection Use Survey (NOPUS), which provides the only probability-based observed data on driver cell phone use in the United States. The NOPUS is conducted annually by the National Center for Statistics and Analysis of NHTSA.
The 2005 rate translates into 974,000 vehicles on the road at any given daylight moment being driven by someone on a handheld phone. It also translates into an estimated 10 percent of vehicles in the typical daylight moment whose driver is using some type of phone, whether handheld or handsfree. The 2005 survey also found the following:
- Handheld use increased in a number of driver categories, including female drivers (from 6 percent in 2004 to 8 percent in 2005), drivers age 16-24 (8 percent in 2004 to 10 percent in 2005), and drivers in suburban areas (4 percent in 2004 to 7 percent in 2005).
- The incidence of drivers speaking with headsets on while driving also increased in 2005, from 0.4 percent of drivers in 2004 to 0.7 percent in 2005.
- In the first nationwide probability-based estimate of the incidence of handheld device manipulation, the survey found that 0.2 percent of drivers were dialing phones, checking PDAs, or otherwise manipulating some hand-held device while driving in 2005.

15 Million Mobile TV Users in the U.S. by 2009
Ten years ago, it was the Internet that threw the telecom, media and marketing worlds into chaos. Starting next year, it will be the mobile phone, according to a new report released today.
Internet research firm eMarketer forecasts that the number of US consumers who watch TV programming on mobile phones will rise to 15 million in 2009, up substantially from only 1.2 million this year.
"Mobile video and audio entertainment are bringing new energy to the US wireless business," says Debra Aho Williamson, eMarketer Senior Analyst and author of the new "Mobile Entertainment: The Rise of the Very Small Screen" report. "There are real opportunities out there."
Major media, telecommunications and entertainment companies are placing big bets on content appearing on mobile phones. Entertainment content could offer mobile carriers a rich new revenue stream - and mobile phones could provide a compelling new platform for media companies and marketers.
"Mobile video will present some of the most compelling mobile entertainment marketing opportunities," says Ms. Williamson. "Just as online video advertising has taken off because of the way it blends video's high brand engagement with the Internet's interactive, tracking and targeting capabilities, so too will marketers be drawn to mobile video advertising."
But while the future looks promising, today's usage of mobile entertainment in the US is currently very minimal. M:Metrics data from October 2005 reveals that fewer than 10% of US mobile subscribers had used their phone's browser to get news and information, send a photo message or purchase a ringtone. Fewer than 5% had purchased wallpaper or a screen saver or downloaded a mobile game.
"Do US consumers want to be entertained by their mobile phone? That's the billion-dollar question," says Ms. Williamson. "Many US mobile phone users think their phone is just fine for talking, and that's about it. Plus, there are significant technology and standards barriers to overcome."

Sprint Nextel picks up Enterprise for $98 million
RESTON, Va.-Sprint Nextel Corp. said it will acquire another of its CDMA affiliates, this time picking up Enterprise Communications for about $98 million including the assumption of debt.
The move is the latest in a string of affiliate acquisitions in the wake of Sprint Corp.'s purchase of Nextel Communications Inc. in August.

The Enterprise deal will put more than 52,000 PCS subscribers directly in Sprint Nextel's pocket, and extend the company's direct service coverage to an additional 825,000 potential customers.

BCGI Gets Reprieve From Court
Boston Communications Group Inc. (bcgi) is claiming a victory in its patent fight with Freedom Wireless. A federal court of appeals has stayed a previously imposed injunction prohibiting bcgi from offering its prepaid mobile phone billing services in the United States.
Bcgi's fight with Freedom Wireless has been ongoing. The company originally was hit with the $128 million patent infringement judgment in May after a jury ruled that bcgi "willfully" infringed on Freedom Wireless' patents. In September, a federal judge upheld the $128 million judgment against the company.
That ruling was followed in October by an imposed injunction that forbid bcgi and Cingular Wireless from selling prepaid wireless services that were connected with the Freedom Wireless patents, which bcgi was found to infringe upon.
The ruling did, however, allow bcgi and Cingular to continue to serve current customers for 90 days, but stated that the companies would have to pay Freedom a 2.5-cent-per-minute royalty for any use during that period. The stay of the injunction also nullifies this requirement to pay royalties to Freedom during the appeals process, according to bcgi.
"We are happy that the appeals court has stayed the injunction," bcgi President and CEO E.Y. Snowden said in a prepared statement. "With this decision in our favor, we are now on solid footing to continue to pursue our appeal."

Google offers mobile phone version of Gmail e-mail
SAN FRANCISCO (Reuters) - Google has created a special version of its Gmail e-mail service that provides mobile phone subscribers with quick access to their e-mail, the company said on Friday.

Details on the mobile e-mail service, which currently is only available to U.S. cellphone users at http://m.gmail.com.
The service works on the subset of more advanced mobile phones that offer an Internet browser. Users can view attached photos and documents from their phone, and reply-by-call to people whose phone number is stored in their Gmail account.
Gmail messages are automatically synchronized between their mobile phones and computer accounts, regardless of whether Gmail is accessed from Gmail Mobile or the Web.

LG Becomes Second Largest Cell Phone Manufacturer in U.S.
According to recently released mobile phone market share data from IDC's Worldwide Quarterly Mobile Phone Tracker, LG Electronics has taken the number two spot across all mobile phone manufacturers in terms of shipment volumes in the U.S. for Q3 2005. After selling 7.8 million handsets nationwide, LG's overall market share rose to 19.6%.
In addition to rising to the number two position in mobile phone shipments in the U.S., LG gained the number one ranking in terms of sales of CDMA phones globally for the third quarter of 2005. LG's overall global market share for CDMA phones jumped 5.1% for a total of 24.3%. In addition, sales of CDMA phones in the U.S. for Q3 of 2005 sustained its number one ranking. Since Q4 of 2003, LG has shipped more CDMA handsets in the U.S. than any other manufacturer, according to IDC.
Building on its well-known leadership in the CDMA market, LG has continued its impressive growth in the GSM category. Just over two years after the launch of its first GSM handset in the U.S., LG again secured the number four spot in the U.S. GSM market in Q3 of 2005. Microsoft Sued Over Patent Infringements
SAN JOSE, Calif. - Mobile e-mail startup Visto Corp. has sued Microsoft Corp. for allegedly infringing on three of its patents related to how information is handled between servers and handheld devices such as cellular phones.

The lawsuit, which seeks unspecified monetary damages and an injunction barring the sale of products, was filed late Wednesday — the same day Visto announced that NTP Inc. had acquired an equity stake in the startup and signed a patent licensing deal.
Visto's allegations against Microsoft are similar to NTP's against Research In Motion Ltd., which now faces the possible shutdown of its popular BlackBerry messaging service in the United States.
"For their foray into mobile e-mail and data access, Microsoft simply decided to misappropriate Visto's well known and documented patented technology," Visto CEO Brian Bogosian said in a statement.
Jack Evans, a Microsoft spokesman, said the company had not been served with the lawsuit as of Thursday morning.
"Until we have an opportunity to see and review this complaint, we're not in a position to comment on it," he said. "Microsoft stands behind its products and respects intellectual property rights."
Visto claims Microsoft, as portable devices handle more e-mail, is making matters worse by bundling its Windows Mobile operating system with its market-leading Exchange e-mail server.
"This method of bundling software has led Microsoft to be prosecuted by competition authorities in the past, and in this case, potentially increases the rate and manner in which their infringement on Visto's patents occurs," the company said.
NTP's deal with Visto also could help it bolster its case against RIM as it can now say it is more than a company that just holds patents and litigates to enforce them. Under the agreement, Visto will have access NTP's patent portfolio for the life of the patents.
"This is a clear win for mobile email users everywhere as it provides them with a viable alternative to RIM that protects them from any NTP litigation risk," Donald E. Stout, NTP's co-founder.
Visto, based in Redwood Shores, Calif., said its clients include Cingular, Sprint-Nextel, the Vodafone Group and Rogers Wireless. It has more than 300 employees and holds 25 patents.
The lawsuit was filed in the U.S. District Court in Marshall, Texas.
Shares of Microsoft lost 18 cents, to $26.91, in Thursday trading on the Nasdaq Stock Market.

Atlanta, Dec. 14, 2005 – A group of industry-leading companies today announced an advanced Near Field Communication (NFC) trial for mobile phone applications including contactless payments, mobile content and premium arena services at Philips Arena in Atlanta. During the trial, Atlanta Thrashers and Hawks season ticket holders with Chase-issued Visa credit accounts and Cingular Wireless accounts can make contactless payments at concession stands and access mobile content from numerous locations throughout the arena. Users can purchase items by simply holding their Nokia 3220 mobile phones equipped with Philips' NFC semiconductor chips and ViVOtech software near a secure terminal. Approximately 150 contactless point of sale (POS) readers have been deployed by ViVOtech throughout Philips Arena. For mobile content downloads, Cingular Wireless will be the carrier that enables these services to take place over its digital wireless network.

The contactless transactions will create faster and simpler payments at concession stands getting fans out of the lines and back to the game. At checkout, the phone is simply held near a secure reader and the contactless payment transaction is automatically charged to the user via the same secure Visa payment network that processes traditional credit card transactions today.
Fans will also be able to access and download mobile content such as ringtones, wallpapers, screensavers, and clips from favorite players and artists by holding their NFC-enabled phone in front of a poster embedded with an NFC tag.

According to global research on digital services for mobile phones commissioned by Buongiorno Vitaminic, downloading ringtones, wallpapers and multimedia games comes third place among the favorite activities of mobile holders, preceded only by calls and texting.
The second edition of the global research into the perception of mobile services, carried out by leading Research Institutes and coordinated by Buongiorno Vitaminic on a sample of 5,000 users, from Europe, the United States and South Africa, confirms the consolidated centrality of these "digital accessories" and, in particular, the interaction between the individual and their mobile has become an extension of the individual themselves.
In fact, with 68% of preferences, downloading ringtones, wallpapers, sound effects and multimedia games, comes third among the favorite activities of mobile users, equal to taking pictures with the mobile digital camera and preceded in popularity only by calls (98%) and sms messages (98%).
The impression given by the indications received from the research is that, everywhere in the world, users are looking for - and more frequently obtaining - feelings of enrichment, personal gratification and exclusiveness. The sensations they want to obtain from mobile service offerings are the same as those they feel when buying fashion clothes or accessories.
Mobile services are no longer a novelty taking their first tentative steps but rather a rich, broad and dynamic market, articulated in well shaped segments and unceasingly nourished by new products.
The first item that emerges from the research is the general improvement in the satisfaction level of users. 1 mobile user out of 2, in fact, considers themselves to be satisfied with the services they bought, judging them to be more alluring, fashionable and closer to personal tastes.
70% of interviewees perceived the offering as more varied, interesting, of better quality and available through clearer acquisition modes.
This increased satisfaction of users is reflected in the increased frequency and quantity of services acquired which more than doubled in the last year. 30% of the sample declared that they download about one product every month, while 14% actually buy one product per week (up from 5% in 2004).
The trend towards higher value services is being driven by ringtones, both polyphonic that account for 22% of preferences compared to 19% in 2004, and those based on high quality audio files (true tones), which jumped from 2 to 10%.
Also, animated wallpapers have increased their popularity from 6% to 8%, while the rating for multimedia games remained almost the same, since it is a segment that counts on a stable demand from heavy users.
The segment of videoringtones (+2%) is rapidly growing, proportional to the introduction of mobile handsets able to support this service.

MTV invests $50 million in Amp'd
LOS ANGELES-MTV Networks will invest $50 million in Amp'd Mobile Inc. and will work with the mobile virtual network operator to offer both repurposed and exclusive, made-for-mobile content from MTV, VH1 and Comedy Central.
"When we began this company, partnering with MTV Networks was our No. 1 goal," said Peter Adderton, chief executive officer of Amp'd. "With MTV Networks' investment, we're also assured the ongoing involvement of the world's foremost youth culture experts. This is a big win for us."

Amp'd said it plans to deliver video clips, ring tones, ringback tones and wallpapers from 10 MTV Networks franchises. The companies will also develop short-form video content including interviews and behind-the-scenes clips exclusively for Amp'd subscribers.
Under terms of the deal, MTV Networks Chief Digital Officer Jason Hirschhorn will join the MVNO's board of directors. The companies said they plan to develop joint marketing and promotions across MTV Networks' brands and advertising channels.
The announcement marks a major win for Amp'd and a substantial move into mobile from the Viacom subsidiary. MTV previously teamed with Virgin Mobile USA to offer ring tones and other branded content, and the company is one of a handful of high-profile media companies already producing content exclusively for mobile users.
MTV also hopes to make an upcoming digital music service available to Amp'd subscribers.

Sprint and MSpot Roll Out Streaming Movie Service
Sprint and MSpot, a pioneer in premium mobile entertainment, today announced the premier of MSpot Movies, the first mobile entertainment service to stream full-length feature films to mobile phones. Available exclusively on the Nationwide Sprint PCS Network, MSpot Movies gives subscribers on-demand access to seven movie genres, including a wide range of titles that MSpot makes available in "chapters," short segments optimized for a mobile audience. Mobile video services are rapidly gaining popularity as mobile phone technology becomes more advanced. Strategy Analytics estimates that more than 150 million people worldwide will be watching video on their mobile phones by 2008. Industry Leaders Test Mobile Phone Contactless Payment
A group of industry-leading companies today announced an advanced Near Field Communication (NFC) trial for mobile phone applications including contactless payments, mobile content and premium arena services at Philips Arena in Atlanta. The trial is the first large-scale test of next-generation mobile phone applications in North America, and is the result of a collaboration between Chase, Cingular Wireless, Nokia, Philips, Visa USA, and ViVOtech, along with Atlanta Spirit, LLC, parent company of the NBA's Atlanta Hawks, NHL's Atlanta Thrashers and Philips Arena. The trial has been designed to enable a secure, wireless system that simplifies payment and services for arena visitors.
During the trial, Atlanta Thrashers and Hawks season ticket holders with Chase-issued Visa credit accounts and Cingular Wireless accounts can make contactless payments at concession stands and access mobile content from numerous locations throughout the arena. Users can purchase items by simply holding their Nokia 3220 mobile phones equipped with Philips' NFC semiconductor chips and ViVOtech software near a secure terminal. Approximately 150 contactless point of sale (POS) readers have been deployed by ViVOtech throughout Philips Arena. For mobile content downloads, Cingular Wireless will be the carrier that enables these services to take place over its digital wireless network.
"By 2010, we expect that over 50 percent of all mobile handsets will incorporate Near Field Communication chips to enable short-range, easy and secure transactions," said Erik Michielsen, director at market analyst firm ABI Research. "As a result, consumers will be able to download content by simply holding their phone close to a poster or advertising billboard. Users can purchase merchandise, food, tickets, and have these transactions charged to a credit card using account information stored in the mobile phone. The NFC implementation at Philips Arena demonstrates NFC stakeholders, including chipmakers, card issuers, device makers, mobile carriers, and content providers, are progressively more willing to collaborate on NFC solution development. This type of co-development is essential to NFC market growth and maturation."
